Abortion to Save the Mother: Permissible?

Question

As-salamu `alaykum. My wife miscarried at the end of the third month of gestation. The ultrasound in the 8th week of gestation showed cardiac activity absent in both fetuses. This was again confirmed in the 10th week. Due to severe bleeding at the end of the 13th week, the doctor advised to abort the pregnancy or it would be dangerous for the mother. Learned scholar, have we done wrong and how should we deal with such a situation according to the Shari`ah?

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

Brother, first of all, we would like to say that we are impressed by your question, which emanates from a thoughtful heart. May Allah Almighty help us all adhere to the principles of this true religion, Islam, and enable us to be among the dwellers of Paradise in the Hereafter. Ameen.

First of all, we would like to state that abortion is forbidden in Islam whether it be in the early or late stages of pregnancy. The degree of sin incurred varies according to the stage of pregnancy, so that less sin is incurred if the abortion takes place during the early stages, while it becomes increasingly haram (prohibited by Allah) as the pregnancy advances. When the pregnancy reaches the 120th day, abortion is totally forbidden and is considered a form of murder that requires compensation to be paid. The only condition under which abortion is allowed is when there is an actual threat to the life of the mother that is confirmed by a medical examination that reveals that if the pregnancy advances any further, the mother may die.

Responding to your question, Sheikh Ahmad Kutty, a senior lecturer and Islamic scholar at the Islamic Institute of Toronto, Ontario, Canada states:

"Your wife has done nothing wrong in aborting the pregnancy in this case as, I understand from your question that she underwent the procedure because of the perceived threat to her life should she carry the pregnancy to the end.

In exceptional cases like this Islam permits abortion. This falls under the category stated in the principle, “Exigencies render the prohibited as lawful.”

So neither you nor your wife should feel guilty about it. Ask forgiveness of Allah [for all your sins] and implore Him to grant you a substitute or patience in your loss."
