Answer

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

Dear questioner, we would like to thank you for the great confidence you place in us, and we implore Allah Almighty to help us serve His cause and render our work for His Sake.

Showing enthusiasm for the aggressive American war on Iraq is a kind of disloyalty to Muslims. Thus, it is prohibited for a Muslim to do so. Moreover, it is religiously required to remove a dictator from rule. However, the removal should not lead to public chaos and sedition, as the well- established rule in Islam states that 'fending off smaller harm must not result in creating a greater one.'

Ibn `Abbas (may Allah be pleased with him) quoted the Prophet (peace and blessings be upon him) as saying: "If someone notices something he disapproves of in the manners of his Muslim ruler, he should be patient, for whoever turns away from the Muslim community even for a short span of time and then dies, he will die as those who died in the Pre-Islamic era of ignorance (as rebellious sinners)." (Reported by Al-Bukhari and Muslim)

Thus, it is prohibited to be enthusiastic and to support the American invasion, as such support is not done for the Sake of Allah, His Prophet and the believers. Rather, a Muslim is obliged to back his fellow oppressed Muslims if they demand it. There are legal channels to change a dictator regime, and for sure it can be carried out without American intervention.

Responding to your question, Sheikh Faysal Mawlawi, Deputy Chairman of the European Council for Fatwa and Research, states the following:

"No doubt that removing dictatorship is something that is religiously required. However, most Muslim scholars are of the opinion that it is not permissible to remove the ruler who is not committed to Islam using the “sword” (i.e., military power) so as to avoid chaos and sedition among Muslims.

In this regard, I stress that assisting the American invasion under the pretext that the Americans will help remove the dictatorship of the regime in Iraq will lead to greater chaos. Not only that, but it will lead Muslims to fight one another, let alone assisting the American invaders to fight Muslims more and more.

This may be possible if we are really convinced that the American invaders will help the Iraqis remove the ruling regime and that they will give freedom to the Iraqis. But I am quite sure that the US is not a charitable society that provides humanitarian assistance. I know that the US is an imperial state that tends to impose its ideology, ethics, economy and even its political decisions on the whole world.

When the Security Council did not approve of launching war against Iraq, the US, along with its allies, decided to launch a unilateral invasion, as the Americans want to accrue interests and profits from such invasion.

For sure, replacing the existing Iraqi regime with another puppet one that is loyal to the States in the full sense of the word comes at the top of the American interests.

Added to the above, I am also sure that the American invasion is likely to achieve many other interests. All such well known interests are not in favor of Islam and Muslims alike.

The American invasion intends to take hold of the public property of Iraq, its natural resources, its oil. Not only that, but it also intends to exterminate the Palestinian cause and suffocate the Palestinian uprising by exercising pressure on Syria to stop its support for the Palestinian intifadah.

Moreover, the American invasion aims to exercise the same pressure on Saudi Arabia to offer concessions related to Islam as a religion, and such compromise is not restricted only to political interests.

Not only that but the American invasion aims to pressurize Turkey and Iran by enticing them with a Kurdish state. This Kurdish state is capable of endangering the national security of both Turkey and Iran.

There are hidden interests behind the American invasion that we are in the dark about. This surely leads us to declare that the Iraqi opposition was really dragged to lend different forms of support to the American invasion under the pretext that such invasion will put an end to the despotic regime in Iraq, hoping that the Americans will play a leading role in laying the foundation for the new regime.

The Iraqi opposition has undoubtedly committed a serious sin. Not only that, but they committed an apparent high treason as they helped the American enemy to control us and agreed to fall as an easy prey before the enemy."

Moreover, Dr. Rif`at Fawzi, former head of the department of Shari`ah at Cairo University, adds:

"Showing enthusiasm for the aggressive American war on Iraq is a kind of disloyalty to Muslims. Thus, it is prohibited for a Muslim to do so. Indeed, the US intends to launch an unjust war on Iraq, and it is not religiously or morally acceptable to show loyalty to this aggressive war, which will destroy the straw and the chaff. The war will have destructive effects on all Muslims, and for sure it will give Israel and its allies a good opportunity to humiliate Muslims. For all these reasons, I see that such loyalty and enthusiasm is forbidden according to the consensus of Muslim scholars."

In addition, Dr. `Ujail Jasim An-Nashami, professor of Shari`ah at the University of Kuwait, states:

"For sure, the Iraqis are Muslim people. They are part and parcel of us. Their blood is our blood, and the demolition of their homes is also a demolition of ours. Thus, it is not permissible for us to participate directly or indirectly in shedding the blood of the Iraqi Muslims. The Prophet (peace and blessings be upon him) is quoted to have said, when beholding Ka`bah: “How sanctified you are to Allah, however, the blood of a Muslim is more sanctified to Allah than you!”

In conclusion, Sheikh Ayat Allah `Ali At-Taskhieri, general director of the International Academy of Approach between Islamic Madhahib, concludes:

"If America succeeds in its war against Iraq, it will flex its muscle more and more, and for sure the American administration will be better able to achieve more strategic aims such as its dominance over the fountains of oil, and will succeed to find a new Sykes-Picot Agreement.

I think that the whole Muslim world will be threatened with American invasion after the success of the American war on Iraq. Personally, I don’t support the Iraqi regime and I don’t deem it a fit one. However, I think that attacking Iraq will lead to untold suffering and unbearable consequences.

I call upon all the scholars of the Muslim Ummah to face the American invasion, and I call all the Arab and Muslim countries to join their ranks so as to avoid the American invasion, which is a real catastrophe that will smoothly take place by the American imperialism."
