All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
Dear brother, we would like to thank you for the great confidence you place in us, and we implore Allah Almighty to help us serve His cause and render our work for His Sake.
First of all, it is to be noted that in Islam, there is no place at all for the notion “the end justifies the means”. It is not allowed to attain good aims through evil means. In line with this Islamic principle, the faults of a ruler should not warrant treason and agency. What the Iraqi opposition is currently doing is not permissible from the Shari`ah point of view. The oppression practiced by the Iraqi regime – though it is totally rejected by Shari`ah – should not allow the destruction of a whole nation on the plea of establishing a just regime. This is because justice cannot be established at the cost of innocents' blood.
In his response to the question, Sheikh Faysal Mawlawi, Deputy Chairman of the European Council for Fatwa and Research, states:
"The cooperation of the Iraqi opposition with the US and Britain for the sake of toppling the Iraqi president, Saddam Hussein, is, in my view, a forbidden act from a Shari`ah point of view and an act of treason from a national viewpoint. Almighty Allah forbids us to take our enemies as patrons against our fellow Muslims, saying: “Let not the Believers take the unbelievers as their patrons over against the Believers. Whoso doeth that hath no connection with Allah…” (Al `Imran: 28)
The Qur'an regards those who seek the support of the enemy as hypocrites, declaring: "Bear unto the hypocrites the tidings that for them there is a painful doom; those who choose the unbelievers as their patrons over against the Believers! Do they look for power at their hands? Lo! All power appertaineth to Allah." (An-Nisa': 138-39)
As for the danger of this act on Iraq, it may lead to its division into minor countries in the North, the Middle, and the South. Even if this does not happen, the American invasion will lead to the total destruction of what is still remaining of Iraq and hence will prevent it from any development in the near future and drag it a hundred years backward. Moreover, it will lead to replacing the current regime – though we have reservations regarding it – with a paid regime that will be completely submissive to the US policies, just like the current regime in Afghanistan.
As for its negative impact on the Arab and Muslim world, it will lead to much more division and increase the American sovereignty over our countries. In addition, it will lead to besieging Syria and pressing her to stop supporting the Palestinian resistance, which is a dangerous measure that will in turn negatively affect the blessed Intifada (uprising)."
