Forced to Disrupt Tamattu` Hajj

Dear scholars, I intended to perform Tamattu` Hajj this year. After I performed `Umrah and put off ihram (clothing of Hajj) for `Umrah, on the 3rd of Dhul-Hijjah, I went to Mina  where I felt some pain and had a swelling in my knees, which crippled me. When I consulted a doctor, he advised me to discontinue Hajj. I truly could not walk, even one meter further, because of the extreme pain. Afterward, on the 5th of Dhul-Hijjah, I returned to Madinah where I live without performing Hajj.

It should be mentioned that when I intended to perform `Umrah, I did not say, "If a force majeure detains me, I shall end ihram wherever I am detained," as the Prophet (peace and blessings be upon him) said. Is saying this statement a condition for ending ihram?

I would like you to tell me whether I have to offer a sacrifice. If yes, is it permissible for me to depute someone to offer this sacrifice in Makkah?

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger. 

Dear questioner, thank you for your question and we pray to Allah to illuminate our hearts with the lights of wisdom and truth.

Almighty Allah never burdens a soul beyond its capacity. Therefore, sickness is a legitimate excuse in the Islamic Shari`ah. When a Muslim falls ill, he or she enjoys concessions and is relieved from certain religious duties.

If a pilgrim who has not assumed ihram and has not started any of its rituals falls sick and becomes obliged to discontinue, he or she will not be subject to any consequential obligation.

Answering this question, the Standing Committee for Islamic Research and Ifta' stated,

If the case is as you mentioned (i.e., you put off the ihram of `Umrah and then discontinued the performance of Hajj and returned to where you live before assuming ihram for Hajj), then there is nothing wrong with that. This is because your `Umrah was finished once you performed it and put off the ihram. As for Hajj, you did not even assume ihram for it.
