Dear questioner, we would like to thank you for the great confidence you place in us, and we implore Allah Almighty to help us serve His cause and render our work for His Sake.
In Islam, Muslims are obliged to defend their countries against aggression. It is therefore haram (unlawful) for Muslims to accept and be contented with the occupation and to fall short in resisting the invaders. It is prohibited for an Iraqi Muslim to cooperate with the occupying troops in Iraq in a way that gives those troops a firm ground and a free hand in Iraq. Thus, there should be a clear distinction between cooperating and merely dealing. Dealing in this regard is different from cooperating.
Responding to the question, Dr. `Uthman Muhammad Gharib, Professor at the Faculty of Al-Imam Al-A`zam in Baghdad, states the following:
"Indeed, there is a big difference between the one who deals with the occupying troops and the one who cooperates with them. The one who deals with the enemy is the one who is linked to the enemy in a way that relatively lessens the evil of the enemy in an attempt to put that evil to a virtual standstill at the end of the road.
Surely, the above is in the interest of the Muslim community. Not only that, but such dealing wards off harms that may be inflicted on them.
Contrary to the above is the one who cooperates with the enemy in a way that enables the occupying forces to have firm grounds in Iraq as well as other parts of the Muslim world. Such kind of cooperation is totally forbidden in Islam.
It is the duty of Muslim scholars to clarify for those who cooperate with the enemy to stop doing so, and to realize that they are committing a prohibited act in Islam. If they don’t stop their act of cooperation, then it is the duty of the Muslim ruler to punish them. Not only that, but the Muslim community should ostracize them and stop dealing with them (i.e. no buying, no selling, and no marriage, et cetera.)
The above ruling is related to the one who cooperates with the enemy. As for the one who acts as a spy for the enemy, then the ruling is different. According to the consensus of Muslim scholars, the spy from among the unbelievers is to be killed if it is proven that he is a paid agent spying for the enemies of Islam against Muslims. As for the Muslim who reveals the secrets of his fellow Muslims to the unbelievers as well as the enemies of Islam, then the ruling concerning him is different according to his status, degree of faith et cetera.."
Moreover, Dr. Abdus-Salam Al-Kubaisbi head of the department of Qur’anic Exegesis and Qur’anic Sciences at the Faculty of Al-Imam Al-A`zam in Baghdad, adds:
"There is a big difference between dealing and cooperating. We can’t ignore that there are different forms of dealing with the Anglo-American troops that are in the interest of the Iraqi people. On the other hand, we can’t deny that there are paid agents who cooperate with the Anglo-American forces and work against the interest of their fellow brothers and sisters. There is a very fine thread that separates the two that can’t be judged in haste. Rather, issuing a final decision, as far as the issue in point is concerned, needs a special handling through the Islamic court system as well as other court procedures, et cetera."
