Expatriates: Do They Have to Fight for Their Homelands?

Question

Dear scholars, As-Salamu `alaykum. We are a group of young Syrian Muslims living abroad. We feel anxious about the approaching danger to our homeland. Is jihad an obligation on us if the (US-led) troops attacking Islam invade Syria? And what if our regime collapses or surrenders? What do we have to do then? Jazakum Allah khayran.

Wa `alaykum As-Salamu wa Rahmatullahi wa Barakatuh.

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

Dear brother in Islam, first of all, we'd like to voice our appreciation for the great confidence you have in us. We hope our efforts meet your expectations. May Allah help us all keep firm on the Straight Path, Amen.

If the enemies enter or attack a Muslim country, every Muslim living in that country is obliged to resist them. The citizens who are living abroad do not have to return unless they are specialized in specific fields needed in fighting and managing the battlefield. Preparation to fight against the enemies is obligatory at both the individual and governmental levels in order to protect the sovereignty of the Muslim nation.

In his response to your question, Sheikh Faysal Mawlawi, Deputy Chairman of the European Council for Fatwa and Research, states:

"Whenever foreign troops attack the land of Syria, jihad then becomes an individual obligation upon all Muslims living on its land. It is not an individual obligation for those living outside it, whether they are Syrians or non-Syrians, unless they are capable of taking part in the acts of fighting (jihad) and if their contributions aid in defeating the enemy. This is because the warring actions, nowadays, do not depend on physical strength or on primary weapons. Rather, it depends on modern sophisticated weapons that need training on them, which is not available for many people.

It goes without saying that the aim of the obligation of jihad is not that the Muslim should expose himself to death but the aim is to defeat and harm the enemy.

But if Muslims are called to fight, they have to answer the call; even if the leading regime surrenders, people must continue fighting through popular resistance until the occupation is vanquished.

Preparation for warring actions is a duty for every Muslim before, during, and after the outbreak of war. This preparation cannot be an excuse to flee from the war. As for the governing regime, it has to be ready completely, and as for the individuals, their fighting against the invading enemy is a popular resistance that needs different preparations other than that of the organized troops led by the government.”
