All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
Dear questioner, we would like to thank you for the great confidence you place in us, and we implore Allah Almighty to help us serve His cause and render our work for His Sake.
Cooperation with the American forces in preserving the country's public wealth against looting is subject to necessity. If there is a dire necessity that calls for the Iraqi police to cooperate with the usurping forces — i.e., if they can't restore stability except with the Americans' help — then they may cooperate with them. However, once everything is settled down, all people must resume their resistance to the usurpers and invaders until every bit of their homeland is freed from occupation.
In this regard, the eminent Muslim scholar, Sheikh `Abdus-Sattar F. Sa`eed, Professor of the Exegesis of the Qur'an at Al-Azhar University, states the following:
It is permissible for some Iraqis to cooperate with the American usurping forces to preserve the country's wealth from looting. Yet cooperation in this case must be on condition that those Iraqis know for sure that they will resist such invading forces as soon as they restore stability in the country and the urgent need of their help no longer exists and that they will not be subordinate to the invaders.
Hence, those who are sure that their situation will be as such may cooperate with the invading forces when there is an urgent necessity for it such as saving the public wealth against looting and plundering and preserving the souls and honors of the Iraqi people. Actually, preserving the souls, properties and honors of people are aspects of urgent necessity that are foremost in the objectives of the Shari`ah.
In other words, cooperation with the American invading forces is subject to the urgent necessity which calls for it. Also, this cooperation should only be in case that it is not possible to achieve peace and security in the country except with the Americans’ assistance. Here we say that necessity knows no laws. Nevertheless, necessity is measured according to its scope. Therefore, the Iraqi police or those individuals must cut every relation with the usurping enemy forces as soon as things are settled down in Iraq, because extending the relation with them more than that means explicit confession to the authority of the invaders over Iraq. Moreover, Sheikh Ja`far Ahmad At-Tahlawi, the prominent Al-Azhar scholar, adds:
The basic ruling is that the people of each country are aware of its welfare more than anyone else. This means that the Iraqi people must play their role in their own land, for none will preserve stability and order in the country better than they will. Also, the Iraqi people themselves would not submit to the authority of the invaders as they would do to their fellow Iraqis. They would succumb to Iraqi authority rather than enemy authority. This fact shows that it would be easier for the Iraqis to establish peace and security in the country by themselves.
A Muslim, by and large, finds nothing wrong in obedience and submission to Muslim authority. Then if the Iraqi police are not able to do it themselves and they are in dire need of external assistance, it will be considered a case of necessity and necessity is measured according to its scope. But the reigns of power in the country must be in the hands of its people. Hence, the American assistance will be a means to achieve security and not an end. Allah Almighty says: (Allah will not give the disbelievers any way (of success) against the believers.) (An-Nisa’: 141)
Therefore, seeking American assistance must be a transitional stage, untill the Iraqi people can run their affairs themselves. On the other hand, if there is no need for the Americans' help, it is then haram (prohibited) to give them any right to take part in running the Iraqi affairs, for this would pave the way for them to achieve their vicious ends. Allah Almighty says: (O ye who believe! Take not for intimates others than your own folk, who would spare no pains to ruin you; they love to hamper you. Hatred is revealed by (the utterance of) their mouths, but that which their breasts hide is greater. We have made plain for you the revelations if ye will understand.) (Aal-`Imran: 118)
He also says: (O ye who believe! Choose not disbelievers for (your) friends in place of believers. Would ye give Allah a clear warrant against you?) (An-Nisa’: 144) You can also read:
