As-salamu `alaykum. Could you please furnish me with a Fatwa concerning the rights of refugees in Islam? Your earliest response will be very much appreciated.

Wa`alaykum As-Salamu Warahmatullahi Wabarakatuh.

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.


Dear sister in Islam, thank you very much for your very interesting question. Really, it is high time to explain Islam’s stance on the rights of refugees and to what extent Islam treats all and sundry in the best way.

In his response to the question, Sheikh Faysal Mawlawi, deputy chairman of the European Council for Fatwa and Research, states the following:

"Islam urges Muslims to treat refugees kindly, irrespective of whether those refugees are Muslims or not. Islam views refugees as human beings who should be treated with due respect. Their rights, as far as Islam is concerned, ought to be preserved. This fact is supported by the Prophetic Sunnah. Before receiving the mission of prophethood, the Prophet (peace and blessings be upon him) is reported to have witnessed a peace treaty conducted by the chiefs of Quraysh. The treaty, known as Hilf Al-Fudul, obliges all parties to support the oppressed and back the weak. Recalling the treaty later, after being ordered to call to Allah, the Prophet, peace and blessings be upon him, is reported to have said: “I had witnessed a peace treaty conducted in the house of `Abdullah Ibn Jud`an. It was better than Humr An-Na`em (the best grazing kind of camels at that time). If I were invited to a similar alliance or treaty in Islam, I would welcome the idea.”

It is clear from the aforementioned evidence that all International Treaties that maintain human rights especially those related to refugees are accepted from the Islamic perspective as long as those treaties really defend refugees from oppression and grant them their rights as human beings.

It stands to reason that Islam lays much emphasis on the rights of refugees. Refugees, as far as Islam is concerned, are granted complete human rights in the same way as Muslims and the People of the Book are treated.

Here, the important point which I’d like to mention is that Islam lends a helping hand to the needy and the oppressed even if they happen to be non-Muslims whom Islam sees nothing wrong in giving them sadaqah if they are really in need of it.

Finally, there is also another point, which is so important. Muslim countries who are keen on applying the Shari`ah should not hand over asylum seekers to their countries if those asylum seekers are likely to face prejudice and oppression in their homelands."
