What is the Islamic legal ruling concerning the current Palestinian Intifada: Is it Jihad in the Cause of Allah? Is liberation struggle regarded as Jihad in the Cause of Allah?

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

Dear questioner, we would like to thank you for your question and the great confidence you place in us. May Allah reward you abundantly for your interest in knowing the teachings of Islam!

Speaking about Jihad in Palestine, the late erudite scholar, Sheikh `Abdel-`Aziz Ibn Baz, may Allah have mercy on his soul, has issued the following fatwa:

"Reliable scholars have unanimously agreed that Palestinians who participate in the current Intifada are sincere and true Muslims, and that their Jihad is in the Cause of Allah. This is due to their being oppressed by the Jews. Thus, they are obliged to defend their religion, their souls, their kith and kin, and their children, and to devote all power and energy in order to drive their enemies out of their home.

Some people who are quite aware of the nature of the activities carried out by Palestinians have made it clear to us the great religious zeal filling the hearts of the Palestinians in addition to their rigorous observance of the application of the Shari`ah.

Based upon what has been mentioned, all Muslims should hasten to support their fellow Palestinian to gain victory over their enemy, to restore their land and to pave way for all Palestinians abroad to return home. This is in pursuant to the words of Allah, Exalted and Glorified be He: “O ye who believe! Fight those of the disbelievers who are near to you, and let them find harshness in you, and know that Allah is with those who keep their duty (unto Him).” (At-Tawbah: 123)

Allah Almighty also says: “Go forth, light armed and heavy armed, and strive with your wealth and your lives in the way of Allah! That is best for you if ye but knew.” (At-Tawbah: 41)

He also says: "O ye who believe! Shall I show you a commerce that will save you from a painful doom?. Ye should believe in Allah and His messenger, and should strive for the cause of Allah with your wealth and your lives. That is better for you, if ye did but know. He will forgive you your sins and bring you into Gardens underneath which rivers flow, and pleasant dwellings in Gardens of Eden. That is the supreme triumph. And (He will give you) another blessing which ye love: help from Allah and present victory. Give good tidings (O Muhammad) to believers." (As-saff: 10-13)

Moreover, the Prophet (peace and blessings be upon him) is quoted as saying: "Fight the disbelievers with your money, your souls, and your tongues."

Since Palestinians are oppressed, it behooves their Muslim brothers to support them against those who oppress them, for the Prophet (peace and blessings be upon him) is reported to have said: "A Muslim is a brother of another Muslim, so he should not oppress him, nor should he hand him over to an oppressor." (Agreed-upon Hadith)

The Prophet (peace and blessings be upon him) also says: "Support your brother, be he an oppressor or oppressed." The Companions asked: "O Allah’s Messenger, supporting him in case he is oppressed is easily fathomable, but how can we support him while he is an oppressor?" The Prophet (peace and blessings be upon him) replied: "By not giving him free rein to oppress people; this is the way you can help him."

In fact, there are many hadiths that shed light on the importance of Jihad in the Cause of Allah, standing by the oppressed, and preventing the oppressor from feeling free to inflict harm on people.

By and large, we supplicate Allah to bestow victory upon our brothers who fight in the Cause of Allah, to bless the steps of all Muslims who seek to help their brothers against their enemy, and to annihilate the enemies of Islam wherever they are, putting them to rout as He always does with transgressors; He is All-Hearing, and Ever-Watchful."
