Question I want to perform Hajj 'Ifrad or Hajj Qiran. I want o know that if I perform Sa`i before the fajr of 8th Dhul Hijjah (i.e. on the 6th or 7th of Dhul Hijjah or night before the 8th Dhul Hijjah) would it suffice for hajj sa`i or will I have to do it again on the 10thof Dhul Hijjah. Thanks.

For those who do Hajj 'Ifrad or Qiran it is permissible to perform Sa'i before going to Mina on the 8th of Dhul Hijjah. However, Sa`i cannot be done alone, they have to do first Tawaf and then Sa`i.

Question Before Hajj, the Haram in Makkah becomes very full. People often pray in the Musallah halls in hotels surrounding the Haram, in which they hear the Imam of the Haram, and follow him in Jama'a prayer. Is this correct? Is it a special ruling for the Haram in Makkah? JazakumAllahu khairun for your reply.

The general rule about Jama'ah prayer is that the lines should be connected and those who stand behind either see the Imam or those who are praying behind the Imam. If these conditions are fulfilled then you can pray in your hotel or on the streets. Following the Imam simply by hearing the voice and not seeing the Imam or those who are praying behind the Imam would not fulfill the requirements of congregational prayer.

Question May I ask if it is permissible (recommended) if I make a donation to a Muslim charity organization for the purpose of offering Udhiyah. This means, as the meat are all canned, I will not get to see the slaughter of these animals, neither will I be able to eat it or divide them into the three equal portions. Can I also make an intention to do it on behalf of my children or would it be better if I do it on behalf of my mother who died whilst I was very young. Jazakallah khairan

The Sunnah of Udhiyah is that a person should do it by his own hands or be present when the sacrifice is done. The Prophe (peace and blessings be upon him) said to Fatimah (may Allah be pleased with her) to stand and watch when he was making sacrifice on her behalf. However, all jurists agree that it is permissible to appoint someone else to do the sacrifice and it is valid even if one does not witness it.

It is also recommended to eat some meat from the sacrificial animal as Allah says in the Qur'an, "... eat from it and give to the poor and needy.." (Al-Hajj 22: 36). It is also permissible to give all the meat to the poor people, if there are more needy people.

One can make one sacrifice on behalf of oneself and all his dependants and one can do more if one can afford it. It is also permissible to make sacrifice on behalf of the parents or other relatives and friends who have passed away as a sadaqah for them.

Question I would like to know if it's ok to have oil in hair in state of ihram i.e. can I take ghusl for Hajj and apply oil (coconut or almond oil) then do the intention for hajj.

It is permissible to put oil before making the intention for ihram, but after ihram started one should not use oil or any perfumes or cosmetics.

Question We are Muslims living in the US. Every year, when the month of Ramadan approaches, disputes erupt what method should be using to determine the beginning of the month of Ramadan, Shawwal, and Thil Hijja. Should we follow any specific country or any country or we should look for the Hilal locally. In some cases, Muslims in one city or even in one family celebrated these religious events in different days, creating an atmosphere of division and confusion. So to solve this problem, we got together and discussed this issue thoroughly, we consulted several scholars and then came up with the following agreement: “In accordance with the Quran and the Sunnah, the agreement of the companions of the Prophet, their righteous followers and the righteous generations who followed them among Ahlus Sunnah wal Jam`ah, and according to the advice of our knowledgeable scholars: We hereby declare that starting with this month of Ramadan 1421 Hijri (2000 CE) that:

1. The beginning of the month of Ramadan and the month of Shawwal shall be determined ONLY by actual moon sighting and not by calculations and Astronomy;

2 – For the purpose of uniting the Muslims in the state of Oregon, all named Islamic Institutions agree to follow the method of local sighting in North America, and to start the month of Ramadan and the month of Shawwal together on the same day;

3. Since the day of Arafa and Hajj are acts of worship associated with specific places we will follow the dates of Arafa and Eid Al Adha as observed in those places. We believe that this agreement is an initial step toward uniting the Muslim Ummah in all aspects of life. We would like to invite all other Islamic institutions in the state of Oregon as well as in other states in North America to join us in our efforts to establish an Islamic system that will serve the Muslim Ummah in the best way.”

Now some people say that this agreement violated the Islamic Shari`ah and is against the Quran and The Sunnah, and hence it is void. They say that there are only two methods to determine the beginning of these religious events, namely the unity of Matla, and the different Matla, and Muslims should follow those two only in all of these events (i.e. Ramadan, Shawwal, and Dhul Hijja). And since this agreement is a mixture of those two methods, meaning taking different methods for different event, this makes it in violation of the Islamic Shari`ah and should be void.

The other side says that this agreement did not violate the Shari`ah and it is within these two methods of determining the time of these religious events lawfully. For Ramadan and Shawwal it used both methods. It considers the continent of North America as one Matla' so it is the method of the unity of Matla', and used the method of the different Matla' as of the rest of the world. But for the month of Dhul Hijjah, it used the method of the unity of the Matla, where it follows the moon sighting in Saudi Arabia. What you agreed upon in Oregon is basically the criteria that is followed by the Fiqh Council of North America. There are some people who disagree with this criteria. There is a need that some prominent Muslim scholars in North America meet together and discuss different aspects of this issue and come up with one resolution. In sha' Allah, we are planning such meeting very soon and shall inform the communities about it. Meanwhile, you can follow whatever method most of the people in your community agree with.

It is very important that Muslims should not make this an issue of fighting and divisions in the community. Allah has give us a Shari'ah that allows some differences of opinion and flexibility in interpretations. We should also try to make things easy for ourselves and others. The Prophet (peace and blessings be upon him) is reported to have said, "The Deen is easy..."

May Allah keep us on the right path and unite our hearts and actions. Ameen.

No, it is not recommended for pilgrims to fast on the Day of 'Arafah; it is for those who are not performing Hajj.

Question I have read somewhere that fasting on the day of `Arafah will expiate for the sins of 2 years. Is this true? Is this for those not performing Hajj? Is this day on 9th January?

The Day of 'Arafah is announced to be 9th of January this year. It is highly recommended for those who are not performing Hajj to fast on this day. It has great blessings and reward and in sha' Allah, it will expiate many sins and shortcomings, if done with the sincerity of heart and full commitment to Allah.

Question I heard that one who intends to offer Udhiyah should cease cutting his nails or shaving until he slaughter the animal. Is this restricted to the one who offers the sacrifice, or it also extends to his family?

This is only recommended for those who intend to offer the sacrifice, but it is not required.

Also, this is only restricted to one that is offering the sacrifice, not the whole family members.

Question Thank you for taking my question. Does a man have to reveal his arms or shoulders during Hajj? I ask because what if a man has a huge tattoo on his left upper arm. Would it be okay as to cover it during Hajj?

First of all, if you can remove the tattoo, it will be much better, for it is haram for the Muslim to have a tattoo.

For uncovering the arm during Hajj, the right arm is to be uncovered in the first three ashwat of tawaf, which is called istibaq. After that it can be covered.

For tawaf, wudu' is required. If at any time wudu' breaks, the pilgrim should stop the tawaf, make a fresh wudu', and then resumes the tawaf.

For throwing the pebbles, wudu' is not necessary though it is recommended and preferable to have wudu'.

Question I have done a really bad thing. I don't know what to do. Last night, I lost my virginity to a prostitute. At that time, I didn't feel bad about it. Right after it was over I realized the seriousness of what I had done. I feel very depressed and stupid. I need to feel closer to Allah and be forgiven. What you did was a serious sin. You must repent, ask Allah's forgiveness and pledge to Allah and to yourself that you will never commit this sin again.

What will help you in your Tawbah (repentance) is to make Salah and do more Istighfar, especially in the later part of the night before Fajr prayer. You should also give Sadaqah to the poor and needy people and fast for few days.

May Allah remove the affect of this sin from your life, keep you on the right path, forgive you and bless you in this and life to come.

You should observe the 9th of Dhul Hijjah according to the decision of your own country. Whatever day has been announced in your area that day should be observed and also you should have `Eidul-Adha with your own people according to the decision of your community.

Helping to maintain law and order and providing safety and security to the people is a very blessed act. You should serve the police with the intention that you will help the people and keep them and their properties safe.

As a policeman you should be fair and just and should not take bribes. In sha' Allah, if you do your work in an honest and fair manner, you will receive the reward.

In your country, there are also many Muslims who need someone to protect their rights. Muslims should serve in the police and army to protect all people and see that no injustice is done to their fellow Muslims as well.

Islam is the religion of common sense and it emphasizes that Muslims should have a sense of priorities awlawiyyat.

Hajj is a great worship. It is obligatory once in life only. After that it becomes Nafl. If you see a poor person in dire need, then I think it is better to help this person rather than going for a Nafl Hajj.

Question Dear Dr. Siddiqi, I have a friend who has confided in me that they have committed Zina several times. This person is also married with a family. I was completely shocked. Now, I do not know what to do. I believe that this person has become addicted to performing Zina -- and I believe it will be quite difficult for the person to stop even though the person realizes they should. I am not sure what I should do with respect to this matter. Furthermore, should this person's spouse be informed of these acts of infidelity which have taken place in the recent past? What are my obligations?

You should counsel this person and help him get rid of this sin. Pray to Allah to guide him and save him from this evil and from the punishment of the Hellfire. If you are unable to help him then direct him to some scholar and counselor who can help him.
As far his wife is concerned, you do not volunteer this information to her. If she ask you then you can guide her; otherwise leave this matter between him and his wife.

Hajj is a great 'Ibadah and it has its benefits and rewards.

However, the issues of crowding, overspending and ignoring other important duties are all very important. Unfortunately, Muslims today lack what our Sheikh Al-Qaradawi calls "Fiqh al-Awlawiyyat" (Jurisprudence of Priorities). It is important that we emphasize this aspect of Islam.

Also, we should keep in mind that not all the crowding is caused by the pilgrims. Some of it is also caused by the lack of proper management and city planning.

If this person performed hajj at his brother's cost when he was a child, then he must perform the fard hajj when he is capable. But if hajj was performed when he was adult, then he has achieved the obligatory hajj, but he can still go for voluntary hajj.

Women should not cover their faces during Ihram. However, it is said that if a woman feels that a non-Mahram is looking at her, then she is allowed to put something in front of her face.
