Question As-salamu `alaykum. Which comes first: going for Hajj or spending money I prepare for Hajj on Jihad and Mujahidin?

"If your Hajj is for the first time (i.e. you did not perform obligatory Hajj), then performing obligatory Hajj takes precedence over giving money for Jihad.

If you have already performed obligatory Hajj, then there is nothing wrong in giving the money allocated for non-obligatory Hajj to Jihad and fighters in the Cause of Allah."

Question As-salamu `alaykum. Salam. My question is regarding sacrificing in `Eid-ul-Adha. Who is liable to do it? I mean, which person is qualified to do this act?

My wife is in possession of some gold, for which she is liable to pay Zakah. Is she also liable to sacrifice during `Eid-ul-Adha?

"Originally, I would like to stress that the udhiyah is a Sunnah. It is not an obligatory act. The person entitled to make the udhiyah is the family man as he is the bread winner of the house. There is nothing wrong if he seeks the financial help of his wife in buying the udhiyah.

Having said this, the man is not permitted to get the money that is supposed to be given by his wife as Zakah in order to buy the udhiyah. We should keep in mind that if one is not financially able to buy the udhiyah, he is not obliged to do so as the issue as I have stated is a Sunnah and not an obligatory act.

Finally, if the woman’s golden ornaments or possessions reaches the amount of nisab, and a complete lunar year passes, then Zakah becomes due."

Question Sorry, I know my questions are completely out of the subject of this session, however, I still hope you can answer them.

1-How do I explain the concept of "ma malakat aymanokum" to non-Muslims? How does it comply with our modern lives? I'm afraid to give any unconvincing answers, especially that it is a bit unclear to me too.

2-Is it permissible for a husband to leave his wealth to his wife on one condition that everything returns to his family members after her death? This is a gesture done by a husband because of a fertility problem, meaning that the couple can never beget children. Many thanks. If you can't answer me, could you at least state where I can find the answers, as I’m sure that similar questions were raised before. Thanks.

Question As-salamu `alaykum.I intended to go for Hajj this year. However, the Israeli occupation prevented me from traveling. What is my status in Shari`ah now?

"First of all, I implore Allah to help Muslims in Palestine to get rid of this oppressive occupation.

As for your case, you are blameless for not being able to go for Hajj owing to the hindrances made by the Israeli authorities. Rather, you will be rewarded by Allah for your intention. This case is known in the Fiqh as the case of ihsar, i.e., a pilgrim prevented from completing his journey to Hajj because of the enemy, illness, etc…

Finally, if you are able to go for Hajj in the coming years, then you should go as long as you will be financially and physically able."

Question As-salamu `alaykum. I am going for Hajj in few days. I have two problems. I did not shave my pubic hair and arm pit hair, since the beginning of Dhul Hajjah and I am going to give Qurbani, is it possible for me to shave my pubic hair now, since I am going to Hajj. I need to be cleaned.

The other question is that I suffer from gas problems, and I wonder how should I address this problem during Hajj as performing ablution frequently Hajj will be very difficult for me. Please respond quickly. Jazakum Allah Khayran.

"Brother, may Allah help you offer the Hajj in the best way, Amen.

As for the first question, you can give priority to the Sunan of Hajj over the Sunan of the Qurbani or udhiyah by shaving before wearing the ihram attire.

As for the second question, you have to bear in mind the fact that wudu’ or ablution is not required in Hajj except in tawaf. So, in tawaf you are required to be pure. If you face a gas problem, i.e., you cannot control the release of the gas – and it’s not a mere waswash or Satanic insinuations, then you can delay tawaf until you find it easy to offer without enduring hardship. If it’s easy for you to renew your wudu’, then you should offer tawaf on time, renew your wudu’, and complete the seven rounds of tawaf. If it’s too difficult to renew your ablution and you cannot delay offering tawaf, you can perform dry ablution or tayammum and complete your tawaf."

Question I would like to know whether I should shave my head during Hajj or should I just trim my hair? I have received different opinions from different people about that. Can you please help me as I am planning to perform Hajj this year insha’ Allah. Jazakum Allah Khayran.

"Shaving the head is better than trimming as the Messenger of Allah (peace and blessings be upon him) is reported to have said: “May Allah forgive those who shave!” People asked: “What about those who trim or shorten their hair?” He replied with the same answer thrice and in the fourth time, he said: “May Allah forgive those who shorten their hair!”

Also, in the Qur’an people who shave their hair are mentioned before those who trim. Allah says: “ Allah hath fulfilled the vision for His messenger in very truth. Ye shall indeed enter the Inviolable Place of Worship, if Allah will, secure, (having your hair) shaven and cut, not fearing. But He knoweth that which ye know not, and hath given you a near victory beforehand.” (Al-Fath: 27)"

Based on the above, shaving is far better than trimming.”

Question As-salamu `alaykum. I would like to know the categories of people to whom the udhiyah should be given? Is it a must for them to be Muslims or is it permissible to give it to non-Muslims?

"According to the Prophetic Sunnah, the udhiyah should be divided into three thirds: one-third for the family, one-third for the relatives whether poor or rich, and one-third for the poor and the needy.

As for giving non-Muslims from the udhiyah, it’s allowed if there is no poor Muslims who are in need of such a gift."

Question My grandparents did not perform Hajj in their life as they were poor and could not afford. Now, I am going for Hajj for the first time. The question is that can I perform Hajj on their behalf and if yes then will my Hajj also be counted as obligatory and what is the intention that one should make while performing Hajj in this case. And what is the obligation on one’s parents who did not have means to go for Hajj in their life.

"Dear brother, you to have know that you cannot perform Hajj on behalf of another person unless you first offer your obligatory Hajj. So, you cannot offer Hajj on behalf of your deceased relatives this year.

Also, you have to know that as long as your parents die while they cannot afford for Hajj, it’s not obligatory on you to offer Hajj on their behalf, for they were financially unable.

However, if you do it on their behalf, this will be of great benefit to them, insha’ Allah."

Question We are going to perform Hajj this year. The problem is that I expect my menstrual cycle on the 9th of Dhul Hijjah, so I will not be able to perform tawaf because we have to come back on the 13th of Dhul Hijjah as my husband has to resume his work on 15th of Dhul Hijjah. Could you please solve this problem?

As for your question, you have to bear in mind the fact that there are safe methods that help stop menstrual blood temporarily. Thus, there is nothing wrong in Shari`ah in making use of such safe methods."
