Question As-salamu `alaykum. I was informed from a scholar in my Pakistani area that they cannot sponsor Hajj to a person who cannot afford it by himself. The scholar further said that the person who cannot afford it is not supposed to perform Hajj. I understand that the person who cannot afford that is not obliged to perform Hajj. Mostly, here in our business companies the owners sponsor their factory workers for Hajj.

My question is: can we sponsor Hajj to our factory workers (i.e. through paying all expenses by the company). In case Hajj is not necessary for a person, can we sponsor `Umrah to the person who cannot afford it.

There is nothing wrong for a company to sponsor their workers for Hajj by providing their fares and expenses for Hajj, so long as such a decision is made in accordance with the guidelines and protocols governing the same.

Although Hajj is not fard on a person who cannot afford it financially, there is nothing wrong for another to volunteer such a help; it is up to the individual who has been offered such help to accept it or refuse it. Some scholars are of the opinion that it is not highly recommended to accept such offers, there is nothing in the sources to suggest it.

With Islam being primarily a religion of mercy and generosity, we cannot discourage people from extending their generosity towards others so long as Shari'ah has not forbidden it.

Question What is the ruling regarding the person performing Hajj on behalf of his mother, but at the tiqat he said the talbiyah for Hajj and forgot to mention his mother?

So long as the person had set out from his home to perform the Hajj on behalf of his mother, it should be fine; for Allah knows our intentions, although it would have been best for him to make mention of his mother while making first making the talbiyah.

Since Allah is Forgiving of our forgetfulness and slips so long as we did not do so willfully, it is enough for this person to mention his mother from the moment he or she remembered to do so.

Question A person made an intention for Hajj ifrad, and after arrival at Makkah, changed his intention to perform Hajj tamattu` and he performed `Umrah and took off the ihram. What should he do, and from where and when should he put on ihram for Hajj?

There is nothing wrong in doing this; he needs to resume his ihram for Hajj from Makkah; he does not need to go outside.

During his Farewell Pilgrimage, the Prophet (peace and blessings be upon him) ordered his companions, who had not brought animals for sacrifice with them, to release themselves from ihram after tawaf and sa'y (i.e. after performing the rites of `Umrah) by turning it into tamattu`, although they had not initially made such an intention in the beginning.

However, a person who does change his intention from ifrad to tamattu needs to offer a sacrifice, for although there is no sacrifice necessary for ifrad, sacrifice is necessary for both qiran and tamattu`. If, he cannot afford to do so, then he needs to fast ten days: three in Hajj and seven after returning home.

Question A person intended ihram for `Umrah and Hajj, but after his arrival to Makkah he lost his money and became unable to sacrifice an animal and, being so, he changed his mind and intended Hajj only. Is this valid? If he is performing Hajj on behalf of another person stipulating for Hajj tamattu`, what should he do?

The person need not to worry; Allah knows his intentions and what has happened to him is beyond his control.

Islam is a religion of mercy; therefore, as stipulated in the Qur'an, if a person cannot afford to sacrifice because of lack of financial means, he can compensate for the same by fasting ten days: three days during Hajj, and seven after returning home. Allah says, "Whosoever resorts to tamatu’, let him offer sacrifice of his means; if he/she cannot afford to do so then let him/her fast three days in Hajj and seven after returning home..." (Al-Baqarah: 196)

Although there is nothing wrong for him if he were to change his intention to perform ifrad so long as he has not released himself from ihram after tawaf and sa'y. This would be fine especially if he cannot afford to fast as has been prescribed in the above verse.

If he were doing Hajj tamatu’ for another person, he is excused in doing what he is doing since what happened to him was beyond his control. Allah does not take us to task for things we have no control over.

Question Is it compulsory to perform two rak'ahs prayer behind maqam ibrahim? If he forgets to do it, what should he do?

It is not compulsory to pray two rak'ahs behind maqam ibrahim after tawaf; rather it is only recommended. So, if a person forgot to do so, he/she does not need to worry. His hajj and `Umrah are not affected by this slip.

There is no reason to worry; if the congregational prayer began while a person is still performing tawaf or Sa'y, he must join the Salah, and then resume where he left off, after having completed the Salah. He need not start tawaf or Sa'y all over again. Stated differently, if he had already done three rounds of tawaf, he need to do only four more rounds and not the seven.

So long as he has done his best according to his means and circumstances he has fulfilled the requirement. If, however, one has deliberately skipped pelting then he should compensate for the same by offering a sacrifice.

Question Why are men not allowed to wear even panties during Hajj?

This is part of tajarrnd (stripping oneself to the barest minimum of requirements) as a kind of conditioning in asceticism which is the very essence of Hajj. Hajj aims at leveling the distinctions separating people of varying ranks and status by reminding them of their humble origin from dust; after death, we all return to dust with the bare minimum of clothes. Likewise, a Haji is dressed in two white shrouds. Hajj thus trains us in humility.

I'm a new convert to Islam. I want to go for Hajj as soon as I can in life. However, I have tattoos on my arms (can't remove them) and I understand one must wear a certain kind of clothing that will expose these.

I feel very uncomfortable about this and while I understand they are forgiven, (that was my past and now I'm a Muslim) but I feel lots of anxiety over them. My question is can I keep them covered during Hajj and perhaps just feed 100 people instead so Allah will forgive me?

If your the tattoos cannot be removed then you need not worry; you are allowed to simply cover the area with the ihram clothes as much as possible. There is no need for you to feed 100 people in this case.

The Prophet (peace and blessings be upon him) is reported to have said, "Once a person has converted to Islam, all of his past sins are wiped out." So you need not worry. Allah is Forgiving and Merciful.

Question Does the state have the right to limit the number of pilgrims every year? And what about using the lot system or qur`ah in choosing pilgrims, is it a valid system?

Yes, if their decision is based on the interests or welfare of the people who are performing pilgrimage as well as the people residing in those cities. Shari'ah is all based on observing masalih or benefits and tangible purposes.

In other words, such decisions are not valid, if they are simply based on the whims and fancies of the decision makers; I am sure the government is resorting to this practice in order to be able to best serve the pilgrims, for there is a limit to what these small cities can hold.

Resorting to the qur`ah or drawing lots in choosing pilgrims is also permissible; the Prophet (peace and blessings be upon him) himself set the precedent for it when he used to choose his wives to accompany him in expeditions through this procedure.
