Question What if we see the new moon on the 28th day of Ramadan?

If the new moon is sighted on the twenty eighth day of Ramadan then we ought to celebrate the `Eid and make up for one day of Ramadan we have missed. For the Arabic month is either twenty nine days or thirty days; it can never be twenty eight days.

Question A period makes the woman stop fasting in Ramadan. But then should a woman stop fasting in Ramadan, when the actual blood appears, or when the brownish drops appear? Thanks you.

A woman must stop fasting when the actual menstrual blood appears; generally speaking, it starts as black, then it may change color into red or yellow or something between white and black; the appearance of complete white color is considered a sign of cessation of menstrual flow.

A woman who had experience of menses should decide by her past experience in such matters.

Question As-salamu `alaikum. I was wondering what is your understand with regard to the hadith of the Prophet that states that in Ramadan both the solar and lunar eclipse will occur and that Hajj will be the coming of the Mahdi? Some scholars have based on this fact and others stated that that with the approach of this Hajj the Mahdi might appear? What is the sound information on this matter based on Hadith?

As far as my knowledge goes, there is no such sound Hadith from the Prophet ( peace and blessings be upon him). We are not to speculate on such matters based on hearsay or unverified reports.

It is important for you to search for another job and go for it--if you can find one. Until then, you need to purify your income by frequent charities and istighfar (asking forgiveness of Allah).

Once you have purified your income in this way, you can use the money for Hajj. May Allah make us all self-sufficient with that which is purely halal for us so that we are not compelled to resort to that which is haram.

Question I have a non-Muslim friend who is living with me. For the past 7 years he had been “fasting” during Ramadan. What do you think about this?

One of the essential conditions of fasting in Islam is that a person observing it must be a Muslim; if your friend has not fulfilled this requisite, he is simply dieting and not fasting. However, you must not discourage him; he may be on his way to Islam. Pray that Allah guide him to the straight path.

Question How should my husband and I observe Laylutul-Qadr if we do not live near enough to a Mosque to pray there?

If both of you are not living in the vicinity of a Masjid, you need to do your prayers and vigils with your fellow Muslim neighbors as much as possible, if they are available.

If you have no Muslim neighbors, then you should do them at home. The exact night of qadr has not been disclosed to us; so we are to seek for it in all of the last ten nights of Ramadan, and more especially in the odd nights. May Allah grant us all the blessings of the night of qadr, Amen.

Question As-salamu `alaykum. Thank you for your great service to Muslims in North America. My question is this: I am a convert, and whenever I go to the mosque, I am completely ignored by "born Muslims." The same scenario occurs when we invite people of my husband's culture into our home. This in turn frustrates me, and makes me feel like backbiting Muslims from this particular part of the world. What can I do to become more active, and avoid this type of discrimination and protect my children from this?

I commend you for your patience with certain Muslims who are acting this way either due to ignorance or due to paganism. You should take this matter up with the Imam or other knowledgeable people in the community so that they can deal with it appropriately. I can assure you that your patience is greatly rewarded by Allah. I pray that He make you steadfast on Islam.

It is best to delay it until iftar-- if you have a choice. Otherwise, you can take it, and follow the ruling of scholars and jurists who are of the opinion that it does not invalidate the fast.

Question As-salamu `alaykum. I want to ask you about the Qiyam prayer. I pray the Tarawih and then the Qiyam prayer in the mosque but I always leave 3 Rak`ahs Witr, and I pray them at home so that I can demand from God what I want. I want to ask if this is better or should I complete the prayer in the mosque?

There is no rigid rule on this issue. Since there is no specific text on this matter, we are free to do either--pray with the Imam or pray at home. Some scholars have preferred praying Witr with the Imam; this is especially the case, if the Imam is reciting qunut loud in the final Rak`ahs of Witr. By joining it we are partaking of a great blessing. Otherwise, you may choose to pray Witr at home; you can engage in prayers individually while doing it.

We read in the traditions from `Aishah that the Prophet (peace and blessings be upon him), sometimes prayed Witr in the beginning, sometimes in the middle of the night and sometimes at the end.

If you happened to do Witr with the Imam, that does not preclude you from praying again at home. In that case, you need not redo your Witr, for one should not pray Witr twice during the same night.

Question Is it permissible to have a party for the little children with their friends in a children's fun place celebrating their birthday? We live in a Western country and the children feel left out if they don’t have one. We celebrate with all the Islamic rules. Only the children and some parents go to a public place for the children and play and have some cake together.

There are two views on this matter. According to one group, such celebrations are considered either haram or undesirable; according to another view, it is not considered either haram or undesirable--so long as we do not consider it as a religious ritual but simply as a harmless custom, free of all un-Islamic trappings, associated with them. So you may follow the latter opinion especially if you are coming from a culture where such customs are strongly practiced.

But while observing it, make sure to keep away from all un-Islamic practices such as drinking, dancing, etc. For at no time such practices can be condoned in Islam.

Certainly you can, provided you have already performed hajj on behalf of yourself first. This is clearly supported by well established traditions from the Prophet, peace be upon him.

Question Is there any daleel that we can ask a dead person to make dua’ to Allah for him (indirect dua’ to Allah through a dead person).

Such a practice is clearly a form of shirk. For this was what the pagans in Arabia used to do; as we read in the Qur'an, the pagans used to say: We are praying to Allaat and `Uzza in order that they may intercede for us before Allah. So we must shun such practices altogether in order to safeguard our religion.

Here in the USA, we started fasting Sunday, and according to the scientist the new moon will be on Sunday 23nov., so the `Eid will be on Monday, so what happened to those countries which start fasting on Monday? Will they going to be fasting only 28 days? Could you please explain it to me.

In such matters you should follow the decision of the congregation, for the Prophet (peace and blessings be upon him) is reported to have said, "Fast with people, break your fast (i.e. celebrate `Eidul-Fitr) with people, and celebrate sacrifice with people."

So we are not to make this kind of decisions based on our own personal preferences or inclinations.

Based on this, if you are living in the USA you must follow the decisions of the Muslims there; if, on the other hand, you are living in another country, then you must go by their decisions. We should not be creating dissensions in the community on this issue. Let us seek to focus instead on far more important issues that are crucial for the survival of Muslims in this time and age.

Question Is it permissible for the woman who has her period to read the Qur’an from a tafseer book while holding that tafseer book in Ramadan &Laylatul-Qadr?

It is permissible to read tafseer so long as she is not reciting the Qur'an.
However, some scholars have also permitted for women who are either teachers or students to read the Qur'an itself if they need to do so.

Question Please comment on the following fatwa:

1. “Taraweeh is a Sunnah Mu`akkadah salah, not just a nafl salah and thus there is a set number of Rakaats for it, just as the number of Rakaats are set for other Sunnah Muakadah salaat eg. 2 before fajr, 2 after Zuhr, 4 before Zuhr etc.”

2. “While ibn Taymiyyah is of the view that no amount has been stipulated, there exists ijmaa of the Ummah that taraweeh is not less then 20 rakaats. From the time of Umar(RA) until the fitnah of not following a mazhab(Salafism/Wahabism etc) started (Approx.. 2 hundred years ago), there was no masjid in the world were less than 20 rakaats of Taraweeh was performed. This was the practice of the Ummah for about 1200 years.”

3. “According to the Hanafi Mazhab, no salah is permissible, reading from the Quran. According to other Mazhabs it is permissible. This doesn't prove that it is not a sunnah Muakadah salah.

Let us not be so stubborn and dogmatic in holding on to our views. There is no report anywhere from the Prophet (peace and blessings be upon him), fixing the exact number of taraweeh. When asked about night prayer, his reply was, it must be prayed in this way: Pray two rak'ah, then another two rak'ah, and when you fear the fajr is approaching, then conclude it by praying witr. If there was definite number of rak'ahs to be prayed, the Prophet (peace and blessings be upon him), would have said so in his reply to the man. Likewise, the reports from `A’ishah are well attested on the fact that the Prophet(peace and blessings be upon him) never prayed twenty.

We also read in the sources that during the time of `Umar, first they started praying less than twenty; they only decided to pray twenty for convenience sake . The fact there was no `ijma’ on it can be verified by the fact that Imam Malik approves praying thirty or more rak'ahs; he had arrived at this conclusion based on the practice he had seen. We must remember that Imam Malik attaches great value to the practice of the people of Madinah. If the people of Madinah had unanimously practiced twenty rak'ahs, it is most unlikely that he would have departed from that practice.

It should be clear from what we said above that there is no `ijma’ on the number of Tarweeh. The statements we find to that effect in the later sources are either exaggerated or simply stating the agreement of the later scholars, which is not the same as the infallible `ijma’ that is considered as binding.

In conclusion: The view of Ibn Taymiyyah on this matter seems to be sound: It is left to the worshippers to choose to pray eight, twenty or more by taking into account their specific level of endurance to read long or short.

As for the issue of permissibility of reading from the Mushaf, it is based on certain precedents from the Companions: We read in the sources that `A’ishah, the beloved wife of the Prophet, peace be upon him, did appoint a boy to lead women in Taraweeh by looking in the Mushaf. So if you wish to follow this precedent, it is quite permissible to do so.
