| Question |
Asalamu alaikum,
It is my understanding that Islam closed the doors to acquiring slaves except for during wars. Is this ruling now cancelled because slavery is no longer recognized globally? If it is cancelled, who Islamically interpreted it as canceled and when? Also, if slavery restarts or an invading army starts to take in slaves, can the acquiring of slaves be re-initiated?
|
| Answer |
Wa`alaykum As-Salaamu Warahmatullahi Wabarakatuh.
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
This is not financial; please ask it in a general session.
However, remember that the Qur'an did not even mention that you can take slaves as a result of war. It only refers to freeing captives with or without ransom.

| Question |
Dear sheikh Assalamu alaikum,
My Husband is a doctor. There are a lot of pharmaceutical companies that offer certain gifts in the form of household appliances, sponsor air tickets or lavish dinner parties and sometimes cheques. In return, they would want the doctor to prescribe their brand of medicines to their patients. I would like to know if it is permissible in Islam to accept such gifts. My husband says that these companies would have pre-decided to give the doctor certain share of their profit and it does not make any difference to them whether their drug is prescribed or not. Moreover, my husband doesn't demand it from them so it is permissible.

Wa`alaykum As-Salaamu Warahmatullahi Wabarakatuh.
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
These gifts as described are permissible to accept as long as the accepting doctor knows himself/herself for certainly that accepting such gifts does not induce him/her to prescribe this medicine. Normally, there are no conditions attached to them. If I was a regulating authority, I would interfere in regulating them and put certain condition on their giving by companies.

| Question |
If I want to study with a loan and I would take it from a bank which I would have to pay it back with interest; is that allowed in Islam, especially for I do not have any other option?
|
| Answer |
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
I don't know why there are no other options. You can always work and study, quit study for a while and work only or be smart and take merit scholarship. I do not consider such a loan a necessity wherever one may be in this globe. Riba loans for study are prohibited like any other interest loans. I know that some students' loans give a grace period without Riba and such loans can be taken only with the condition that one has a definite source to pay within the grace period.

| Question |
My Mother (may Allah has mercy on her) passed away early this year. She left a house. The deed is in her Name. She left five sons and three daughters as Heirs. However, the house was bought 28 years ago by four of her sons and the house deed was issued in our mother's name. The official hasr el erth (limitation of succession) listed the eight children as heirs. My question is: "Should the funds of the sale of the house be distributed a) among the eight children as per hasr el erth or b) among the four Sons who actually bought the house for mother.
P.S. Our Father passed away 45 years ago and the 4 sons were taking care of the family expenses until our mother's death.

| Answer |
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
May Allah give mercy and blessing to the soul of your mother and father!
It is apparent that your mother did not leave any of her own parents. As long as the deed is in the name of the mother, and there is no evidence to indicate that the house - when bought - was intended as a gift to the mother; this property may be divided to the 8 heirs on 13 shares, 2 shares to a male and one to a female Of course. This is in accordance with this hasr el irth that you mentioned.
But, since you know for certainty that it was paid for by the four sons, who also paid a lot more than that and most likely are still willing to sacrifice for their siblings; it is clear that recognizing their good action with gratitude and thankfulness is an act of goodness that our Shari'ah always recommends.
We are told by our dear Prophet that "He who does not thank [good doing] people, does not thank God too."
If I were one of the other four children, I would forsake my share to the four who purchased it in recognition of their long life good deed with me for 45 years.

| Question |
I am native speaking Arabic, is it ok to sell my skills to US government as a translator? Please advice.
|
| Answer |
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
Yes, this is permissible. Of course, you are going to do it with full honesty. A translator is not an informant. It is wrong to be informant to any government because that implies spying on someone that is demeaning.
