Using Siwaak and Toothpaste By The one that Is Fasting
Question: What is the ruling on using siwaakfor the fasting person, especially if he uses toothpaste with it?
Answer by Sheikh Yussuf Al-Qaradawi:
Using siwaak is well liked at all times. It is preferred before noon, and the jurisprudents have differed about using it after noon. Some say: “It is not liked for a fasting person to use siwaak after noon.” Their evidence for this is that the Prophet (pbuh) said: “By the One in whose Hand is my soul, the smell of the mouth of the fasting person smells better with Allah than the smell of musk.”
So they view that it is not good for the Muslim to remove this smell of musk, or they hate that it be removed, since this smell is accepted and liked by Allah. The fasting person is to accept it and not remove it. And this is like the blood from injuries that a martyr has. The Prophet (pbuh) said about the martyrs: “Cover them along with their blood and clothes. Verily they will be raised with it on the Day of Resurrection. The color the color of blood. And the smell, the smell of musk.” This is why the martyr remains with his blood and clothes, he is not washed and the blood stains are not removed. So an analogy was made between this and that. But the truth is that an analogy cannot be made between them. Some of the companions say that one of them said: “ I saw the Prophet (pbuh) use the siwaak many times while fasting,” so using the siwaak while
fasting is preferred at any time from the beginning of its day to its end - just as it is preferred before and after siyaam. This is a Sunnah that the Allah's Messenger (pbuh) conveyed and said: “Siwaak is a purification for the mouth, and pleasing to the Lord.”
Here, he did not differentiate between fasting and not fasting.
As for toothpaste, one should be cautious while using it so that none of it enters the stomach. And according to most scholars, that which enters the stomach invalidates the fast. Which is why the best thing for the Muslim to do, is stay away from this until after eating [at sunset]. But if one uses it cautiously and carefully, and something of it enters his stomach then he will be pardoned from it. Allah, The Glorious and Exalted, said:
“And there is no blame on you if you make a mistake therein except in regard to what your hearts deliberately intend.” (33:5)
And the Prophet (pbuh) says: “Lifted from my nation are the mistakes, forgetfulness, and that which they have been compelled to do.” And Allah knows best.
